National Contractors.com Membership Terms

pon signing up for membership to NationalContractors.com, you agree to the following terms and conditions. Parties are referred to herein as "Member" purchaser of service and "Client" construction project owner.

National Contractors.com owns all project data and content is protected by copywrite and corporate ownership laws. Under no circumstances is any content to be distributed, resold, posted or used by another competitive lead service or any Internet company, website or entity to generate profit and or gain. Any company and or individual identified as taking content for any purpose other than bidding on the project could face possible legal action and will be prosecuted to the full extent of the law. From time to time National Contractors.com reserves the right to audit the system and use investigative matters to moniter the threat of piracy and theft of proprietary copywrite protected data.

Your membership will include access to our incoming project database with email notification of projects that match your profile Your bank statement will reflect a charge from our authorized internet billing agent: National Contractors.com

Questions/Problems pertiaining only to billing should be directed to billing@nationalcontractors.com or 1-877-783-3174. Membership service and support contact is members@nationalcontractors.com or 1-800-935-6265. No personal information is otherwise sold or distributed. Credit Card, E-check or any other banking information submitted for billing purposes is NOT retained or shared. In consideration of this Agreement, the parties hereby agree as follows:

National Contractors.com hereby agrees to refer Member to Client for the purpose of Member's bidding on and seeking to enter a contract with Client for work on the Project. National Contractors will provide information concerning the Project and the Client to Member that has been provided to National Contractors by Client. Member understands and agrees that National Contractors.com seeks to obtain reliable clients, it has not provided an independent investigation into the information provided to it by Client and does not make any representations or warranties, express or implied as to the accuracy of any information provided by National Contractors.com to Member regarding the Client or the Project.

National Contractors.com has not made, and will not have the right to make any commitment or commitments on behalf of Member or Client.  All terms of any agreement between Member and Client shall be independently negotiated between them. While National Contractors.com will utilize reasonable efforts to locate qualified clients and projects, it is understood and agreed that National Contractors.com is not a promisor or guarantor of any Client's qualifications, financial status or ability to perform any contract it may enter into with Member. Member shall make an independent investigation and determination of Client's qualifications and shall hold National Contractors.com harmless from any failure of Client to meet Member's qualifications and National Contractors.com shall have no liability of any kind to Member in the event that Client fails to perform any obligation under any contract with Member.

No additional fees, above and beyond membership fees, will be due for bidding or winning projects.

Member hereby agrees to indemnify National Contractors.com, its officers, directors, employees and agents and to hold them harmless from and against any claim, loss, expense, damage or liability (including reasonable attorneys fees and out of pocket expenses) arising out of or based upon any contract between Member and Client. Member understands that National Contractors.com cannot guarantee the validity of every project on the site and member agrees to indemnify and hold harmless National Contractors.com against any claim of invalid or outdated project data. National Contractors does try to ensure that all project data is up to date and valid, but cannot guarantee the validity of projects.

Member agrees that this bidding information will not be resold or passed on to any other entity or person for the purpose of redistributing the information for gain or profit. This information is specifically to be used by the member for the sole purpose of estimating and winning the construction project. Member agrees that payment for access to the system is defined as one licensed permit for access to our projects and can only be used by the actual paying member. If additional persons or companies are using the system additional permits and licenses must be issued. Any member or members that are found sharing the system with other non paying persons or entities will be immediately removed from the system without refund and could possibly face legal action.

To the extent that member is a corporation or an individual, member is duly organized and validly existing under the laws that govern your business,  member has full corporate power and authority to execute, enter into, and deliver this Agreement, and  have full corporate power and authority to carry out your obligations hereunder. You state that the information you provide to National Contractors.com when registering for the Program is and will remain true, complete, and accurate. You understand that entering false information or falsifying information during the signup process is against the law.  In connection with the Program, you will comply with all applicable laws and regulations.

Member agrees that his business or corporation is legal and that he or she is appropriately registered, licensed and legal under the federal, state and local laws the business, corporation or individual is governed under. Member states that they are a representative of their company both individually and corporately and through that vested power are licensed, bonded and insured to the extent the governing state requires in that particular bidding area or areas the member chooses to participate in.
 
"6-12 Month Payment Terms"
Member will read and agree to the individual plan details listed on this page before going through the signup process. Member understands that the 6-month and 12-month payment plans require a commitment of payment for the entire cycle and the account cannot be cancelled until after the end of the 6-month or 12-month cycle. Member agrees to keep a valid credit card on the account at all times so that monthly billing can take place. At the end of the 6-12 month cycle the member will have the option to cancel membership, if the member wishes to stay active the membership will continue at the same discounted rate until member chooses to cancel.

"Month to Month Payment Terms"
Notice: month-to-month plan does not automatically cancel after one month even though the month-to-month payment plan can be cancelled at any time.  To avoid re-billing for the following month the account must be cancelled before the 1st day of the next 30-day billing cycle. The month to month account will remain in active status until the plan is cancelled. If the member cancels on the 2nd day the account will remain active for the remainder of the days in that particular 30-day billing cycle. Member understands that there are no trial periods and the first months billing fee is non-refundable.

"Billing Terms"
Member will keep an active up to date credit card on file at all times. National Contractors.com will provide prominent links so member can update billing information as needed if for any reason the primary card on file expires or is unable to be billed. Member will at no time dispute or chargeback any charges that are part of the payment plan selected. National Contractors.com will refund any charges that are double billed or accidental on our part. National Contractors reserves the right to employ an outside collection agency to collect outstanding funds.

"Chargeback Terms"
Member agrees to not initiate a dispute that can lead to a chargeback on monthly payments. In the event of default or dispute/chargeback National Contractors.com reserves the right to employ an outside collection company to collect any outstanding balances on the members account. A 30.00 dispute penalty will be added for each specific dispute incident for adiministrative costs incurred through National Contractors.com. Each dispute penalty will be added on to the entire outstanding balance.

This Agreement shall be binding upon the parties' successors and assigns.

This Agreement shall be deemed entered into in the State of Arizona and the laws of such state shall control. Any dispute between the parties shall be resolved by binding arbitration before the American Arbitration Association ("AAA") in accordance with the AAA's Commercial rules of Arbitration. The arbitration shall take place in Maricopa County, Arizona and the parties expressly consent to jurisdiction therein. The prevailing party in any such arbitration shall be entitled to an award of its reasonable attorneys fees and costs incurred therein.

This Agreement constitutes the entire agreement of the parties hereto and supercedes any prior verbal or written agreements with respect to the subject matter hereto

These terms and conditions apply to any person or company that is accepted as a member of National Contractors.com

12-month commitment Terms and Conditions
I have selected the 12-month commitment option that reduces my monthly fees to $24.99 USD per month. I understand that this is a written commitment and by agreeing to these terms I am responsible for the monthly fee of my membership for 12 consecutive months. During the 12-month cycle, I will be charged $24.99 USD per month and I will automatically be re-billed on a monthly basis throughout the 12-month term. Should I choose to cancel my membership after the 12-month commitment it can be done by contacting National Contractors.com by phone at (800) 935 6265, email to members@nationalcontractors.com or online at customer service. By submitting my billing information, I certify that I have read and agree to the member terms and I also have read and understand the financial terms listed here.

6-month commitment Terms and Conditions
I have selected the 6-month commitment option that reduces my monthly fees to $31.99 USD per month. I understand that this is a written commitment and by agreeing to these terms I am responsible for the monthly fee of my membership for 6 consecutive months. During the 6-month cycle, I will be charged $31.99 USD per month and I will automatically be re-billed on a monthly basis throughout the 6-month term. Should I choose to cancel my membership after the 6-month commitment it can be done by contacting National Contractors.com by phone at (800) 935 6265, email to members@nationalcontractors.com or online at customer service. By submitting my billing information, I certify that I have read and agree to the member terms and I also have read and understand the financial terms listed here.

Month to Month Terms and Conditions
I have selected to be billed monthly at the rate of $39.99 USD per month. I may cancel my membership at any time prior to the end of my billing cycle for the current month by contacting National Contractors.com by phone at (800) 935 6265, email to members@nationalcontractors.com or online at customer service. By submitting my billing information, I certify that I have read and agree to the member terms and I also have read and understand the financial terms listed here.
I agree to month to month membership.
